Kid Speech Language Pathology P.C. (d/b/a KidSLP)

1. Agreement to these terms

These Terms of Use govern your use of kidslp.com and of our text, WhatsApp, and Facebook Messenger channels (together, the “Site”). The Site is operated by Kid Speech Language Pathology P.C., a New York professional corporation doing business as KidSLP.

By using the Site you agree to these terms. If you do not agree, please do not use the Site.

2. The Site is information, not care

Everything on this Site is educational. It describes speech-language pathology in general terms so that caregivers can decide whether to reach out to us.

• It is not medical or clinical advice, and it is not a substitute for an evaluation by a licensed speech-language pathologist or for advice from your child’s physician.
• Using the Site does not make your child our patient. No clinician–patient relationship is created by reading this Site, submitting a form, sending us a message, booking a consultation, or receiving a reply from us. That relationship begins only when we have accepted your child for services and you have signed our Client Service Agreement.
• Do not delay seeking care because of something you read here.

If your child is having a medical emergency, or is choking or in respiratory distress, call 911 or go to the nearest emergency room. Our messaging channels are not monitored around the clock and are never to be used for emergencies.

3. Where we can provide services

Speech-language pathology is a licensed profession, and licensure is generally determined by where the child is physically located at the time of the session, not by where we are.

We provide services only in states where our clinicians hold an active license or are otherwise authorized to practice. Nothing on this Site is an offer to provide clinical services anywhere we are not authorized to do so. If we cannot serve your family in your state, we will tell you and, where we can, point you toward other options.

4. Requests, scheduling, and fees

• A form submission or message is a request, not a booking. An appointment is confirmed only when we confirm it to you directly.
• We may decline to accept a family for any lawful reason, including when a child’s needs are outside our scope of practice or we are not licensed in their state.
• KidSLP is a private-pay practice. We do not bill insurance. Fees, payment terms, cancellation terms, and everything else about the therapy relationship are set out in the Client Service Agreement you sign before services begin. If those documents and these terms ever conflict about your care, the Client Service Agreement controls.
• Good Faith Estimate. Because we do not bill insurance, you have the right under federal law to receive a Good Faith Estimate of expected charges. See our Good Faith Estimate notice.
• Any fee information on the Site is subject to change and is not an offer or a quote.

5. Messaging, and our automated assistant

You can reach us by text message, WhatsApp, and Facebook Messenger. Your first replies on those channels come from an automated assistant, not a person; a member of our team reviews every inquiry.

• The assistant collects basic routing information only. It does not provide clinical advice and cannot assess your child.
• Message frequency varies. Message and data rates may apply. Reply STOP to opt out of texts and HELP for help. Consent to receive texts is not a condition of receiving services.
• Do not send protected health information, detailed medical history, or documents through these channels. Once you are a KidSLP family, we will give you a secure portal.
• WhatsApp and Messenger are operated by Meta and are subject to Meta’s own terms and privacy practices, which we do not control.

6. Who may use the Site

You must be at least 18 years old to submit information through the Site. If you submit information about a child, you confirm that you are that child’s parent or legal guardian with the authority to share it and to seek services on their behalf. The Site is not directed to children.

7. Acceptable use

You agree not to:

• Use the Site for any unlawful purpose, or to harass, threaten, or impersonate anyone
• Submit false information, or information about a child you have no authority to share
• Attempt to gain unauthorized access to the Site, our systems, or another user’s data
• Scrape, crawl, or harvest content or contact information by automated means
• Introduce malware, or interfere with the operation or security of the Site
• Reproduce or republish our content except as section 8 permits

8. Our content and trademarks

All content on the Site — text, graphics, photographs, illustrations, logos, page design, and the arrangement of it — is owned by KidSLP or used under license, and is protected by copyright and other laws.

You may view, download, and print pages for your own personal, non-commercial use as a caregiver. Any other use — republication, distribution, incorporation into another service, or use to train a machine-learning model — requires our written permission.

“KidSLP,” “Kid Speech Language Pathology,” and our logo are our trademarks. Other names and marks on the Site belong to their owners and are used for identification only.

9. Reviews and testimonials

Reviews and testimonials on the Site describe the experience of the individual family who gave them. They are shared with permission. They are not a promise or guarantee that any other child will achieve a similar outcome. Progress in speech-language therapy depends on the child, the goals, and many factors outside our control.

10. Links to other sites

The Site links to third-party resources. Those links are for convenience. We do not control, endorse, or take responsibility for the content, accuracy, or privacy practices of any site we link to.

11. Disclaimer of warranties

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, KidSLP disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Site will be uninterrupted, secure, error-free, or that its content is complete, accurate, or current.

This section limits warranties about the Site. It does not limit the professional duties we owe to a child who is our patient under our Client Service Agreement and applicable law.

12. Limitation of liability

To the fullest extent permitted by law, KidSLP and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of your use of, or inability to use, the Site — even if we have been advised that such damages are possible.

To the fullest extent permitted by law, our total liability arising out of or relating to the Site will not exceed one hundred dollars ($100).

Some states do not allow certain limitations, so parts of this section may not apply to you. Nothing in these terms limits liability that cannot be limited by law, including liability for professional negligence in the provision of clinical services.

13. Indemnification

You agree to indemnify and hold harmless KidSLP from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of your misuse of the Site, your violation of these terms, or your violation of the rights of another person — including submitting information about a child without the authority to do so.

14. Accessibility

We are working to keep this Site usable by everyone, including people who use assistive technology. If you encounter a barrier, please tell us at info@kidslp.com so we can fix it and help you get the information you need another way. See our Accessibility statement.

15. Resolving a disagreement

If you have a concern, contact us first at info@kidslp.com. Most things are resolved with a conversation, and we would rather have one. Please give us 30 days to work it out with you before starting a formal proceeding.

16. Governing law and venue

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising out of these terms or your use of the Site will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the jurisdiction of those courts.

17. Changes to these terms

We may update these terms. The “Last updated” date at the top shows when. Your continued use of the Site after a change means you accept the updated terms.

18. General

• Severability. If any provision is held unenforceable, the rest remains in effect.
• No waiver. Our failure to enforce a provision is not a waiver of it.
• Assignment. You may not assign these terms. We may assign them in connection with a merger, acquisition, or sale of assets.
• Entire agreement. These terms, together with our Privacy Policy, are the entire agreement between you and KidSLP about the Site. They do not replace the Client Service Agreement, the Notice of Privacy Practices, or any consent form you sign as a KidSLP family.
